The short version
BioByte keeps your medical history in one place and helps you ask questions about it. It gives you general wellness information. It is not your doctor and does not give medical advice.
Never delay getting care because of something BioByte said. For an emergency, call your local emergency number.
Your record is yours. You keep it, you approve what goes into it, and you can delete all of it at any time.
1. Wellness information, not medical advice
This is the most important thing on this page. BioByte gives you two kinds of thing, and they have different rules.
Facts about you come only from your own records, and every one of them is shown with the document it came from. General health information is exactly that: what a marker measures, what a range typically means, what commonly influences a value. It is general information, and it is never a statement about your body.
BioByte will not state a diagnosis as a fact about you. It will not tell you to start, stop or change the dose of any medication or supplement, because that decision belongs to the person who prescribed it. It will not advise you against something your clinician has told you to do. When something sounds urgent, it will point you at emergency care before anything else.
Nothing BioByte shows you is a substitute for professional medical judgment. Decisions about your health belong with your clinician, who can examine you and knows things your record does not contain. Never disregard professional medical advice or delay seeking it because of something you read in BioByte.
2. Emergencies
BioByte is not an emergency service and is not monitored. If you think you are having a medical emergency, call your local emergency number or go to an emergency department now. Do not use BioByte to ask whether a symptom is an emergency.
3. Who can use BioByte
You must be 18 or older to have a BioByte account, and you must be able to enter into a binding agreement where you live. BioByte is offered for personal use with your own records, or with records you are legally authorised to hold and manage for someone else.
BioByte is not a medical device, is not intended to diagnose, treat, cure or prevent any disease, and is not certified for clinical use. Do not use it as a system of record for patient care.
4. Your account
Keep your sign-in credentials to yourself and let us know if you think someone else has reached your account. You are responsible for what happens under your account. Give us accurate information when you sign up, and keep it current, because the record only works if it is about you.
5. Your content stays yours
You keep every right you already had in the documents you upload and the record BioByte builds from them. You give us only the permission we need to run the service for you: to store your files, process them, extract a record from them, index them so you can search, and show all of it back to you.
That permission exists to operate BioByte for you and nothing else. We do not use your medical records to advertise to you, we do not sell them, and we do not license them to anyone. The permission ends when you delete the content or your account, except where we are required to keep something by law.
6. Accuracy, and the part that is yours
BioByte reads documents with AI, and AI misreads things. That is why nothing is filed without you approving it: extraction lands as pending, shows you what it found and how confident it was, and becomes part of your record only when you confirm it. Where a value or a unit is wrong, you can correct it before you confirm.
This means the review step is a real responsibility, not a formality. Check values, units and dates against the document in front of you. A confirmed record is one you have said is right, and BioByte will treat it as such from then on. We do not warrant that extraction is accurate, and you should not rely on your BioByte record as the only copy of anything that matters. Keep your original documents.
7. Acceptable use
You agree not to:
- upload records belonging to someone else without their consent or your legal authority to act for them;
- try to reach another user's account, records or files, or probe, scan or test the security of the service;
- use BioByte to provide clinical care to other people, or to build a competing dataset;
- scrape, resell or redistribute the service, or use automated means to place load on it beyond ordinary personal use;
- upload malware, or anything unlawful; or
- reverse engineer the service, except where that restriction is unenforceable.
8. Changes to the service
BioByte is under active development and will change. We may add, alter or withdraw features, and we may set reasonable limits on things like upload size or how often a request can be made. If we make a change that removes something you rely on, we will give you notice in the app where we reasonably can, and your right to export or delete your record is not something we will take away.
9. Ending it
You can delete your account from Vault in the app at any time, and that deletes your documents, your records and your chat history permanently. You do not need our permission and you do not have to tell us why.
We may suspend or close an account that breaks section 7, or where we are required to by law. Where we can give you notice and a chance to put it right first, we will.
10. Disclaimers
BioByte is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, that it will be error free, or that anything it extracts or generates is accurate or complete.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
11. Limitation of liability
To the fullest extent the law allows, BioByte is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or the cost of substitute services, arising out of or relating to your use of the service.
To the fullest extent the law allows, our total liability for all claims relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one hundred United States dollars.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
12. Governing law
These terms are governed by the laws of the state in which BioByte is organised, without regard to its conflict of law rules, and by the federal law of the United States where that applies. If any part of these terms is held unenforceable, that part is limited to the minimum extent necessary and the rest of the terms stay in force.
13. Changes to these terms
If we change these terms we will change the effective date at the top of this page, and we will tell you in the app before a material change takes effect. If you keep using BioByte after that, the new terms apply. If you do not agree with them, delete your account, which you can always do.
